WTF?: Americans Must Have Criminal Checks Before Contacting Foreigners on Internet
Posted by Chris Farris under Stupid PeopleIMBRA makes it a felony for an internet dating company, that primarily focuses on introducing Americans to foreigners, to allow any American to communicate with any person of foreign nationality without first subjecting that American to a criminal background check, a sex offender check and without first having the American certify any previous convictions or arrests, any previous marriages or divorces any children and all states of residence since 18. Match.com is excluded from the law, and the judge found that this exception posed no challenge to the Fifth Amendment equal protection clause because American women are supposedly not abused by American men that they meet on the internet, and thus are not in need of protection.

Lets start with Brownback is a douche and will hopefully never see the White House unless he is driving by it. Now lets consider enforceability. How is the mighty imperial federal government going to enforce this if I go to www.buyarussianbride.ru? Now lets talk about unintended consequences. How many women will now be stuck living in their primitive shit-hold countries, because American men aren’t going to go through the indignity of a background check just to talk to these people.
Finally, what the fuck happened to Congress shall make no law .. abridging the freedom of speech, or the right of the people peaceably to assemble.

The law can be enforced two ways. First, the dating companies can be prosecuted in federal court for a felony or sued civilly by any US Attorney.
Second, if a man meets a woman on a dating site that does not comply with the law, later falls in love with her and either marries her or gets engaged to her, SHE WILL NEVER GET ANY KIND OF VISA TO COME TO THE US. This is the case even if the man innocently uses a dating company that does not comply with the law.
At this time, there is extremely limited enforcement of the law. The only enforcement is that the fiance and marriage visa application forms are changed and applicants must state how they met their fiance/spouse US citizen.
I do not know the reason the other parts of the law are not being enforced, but it could be that DHS knows that this is an unconstitutional law and also that it will be difficult to enforce further. Just imagine that (1) DHS makes a list of who is a covered dating service and who is exempt*, not an easy task and (2) they start turning down wholesale everyone who met on “Maria’s Latinas” or “Imelda’s Filipinas” or “Natasha’s Russians”. If they did that, the hue and cry of those rejected would be loud, very loud, and it would reach the ears of the foolish Congressmen who passed the law and the foolish media that has ignored it thus far.
*Big dating companies such as Match.com, Yahoo personals, etc are exempted from the law
